1. Introduction

Welcome to K7Tracks, a professional marketplace where sellers can create stores to buy and sell new and used gear, including audio equipment, electronics, computers, and other related items. By creating a store on K7Tracks, you agree to comply with these Seller Terms & Conditions, which aim to protect all users, including sellers, buyers, and K7Tracks itself. Please review these terms carefully.

2. Eligibility

To register as a seller on K7Tracks, you must:

  • Be at least 18 years of age.
  • Provide valid, accurate, and complete information during the registration process.
  • Agree to adhere to all applicable local, state, federal, and international laws governing your sales activities.
  • Have a valid bank account or payment method for disbursement of funds.

3. Store Creation and Maintenance

  • Sellers may create a personal store on K7Tracks and are solely responsible for the management of their listings, inventory, pricing, and customer interactions.
  • You must maintain accurate, truthful descriptions and update your inventory regularly to reflect available stock.
  • K7Tracks reserves the right to review, suspend, or terminate any seller’s account if the terms outlined in this agreement are violated.

4. Prohibited Items

To maintain the integrity of the marketplace and ensure legal compliance, sellers are prohibited from listing the following items:

  • Illegal Drugs: Including controlled substances and drug paraphernalia.
  • Pirated Software/Media: Unauthorized copies or digital downloads of music, software, movies, or other intellectual property.
  • Stolen Goods: Any item obtained through theft, embezzlement, or other illegal means.
  • Counterfeit Goods: Fake or falsely branded items.
  • Hazardous Materials: Items that are explosive, flammable, or otherwise dangerous, including fireworks, chemicals, and corrosive materials.
  • Weapons: Firearms, ammunition, explosives, knives intended for violent use, and related items.
  • Adult Material: Pornographic items or services, including sexual or adult content, images, or videos.
  • Animal Products: Items from endangered or protected species, as well as live animals, animal parts, and furs.
  • Fraudulent Items: Products designed to deceive buyers, including fake identification cards, counterfeit currency, or scam products.
  • Surveillance Equipment: Unauthorized surveillance tools, including hacking devices, signal jammers, and hidden cameras.
  • Medical Devices and Medications: Unapproved or illegal medical devices, prescription medications, or over-the-counter drugs without proper authorization.
  • Tobacco Products: Including e-cigarettes, vape products, and smoking accessories.
  • Alcohol: Alcoholic beverages unless you have specific, verified licensing for the sale of alcohol.
  • Lottery Tickets and Gambling Devices: Any form of lottery tickets, gambling equipment, or items intended to facilitate illegal gambling activities.
  • Offensive Materials: Hate speech, discriminatory items, or items promoting violence, terrorism, or discrimination.

K7Tracks reserves the right to remove listings at its sole discretion and may suspend or terminate accounts found in violation of these prohibited item policies.

5. Seller Obligations

When selling on K7Tracks, you agree to fulfill the following responsibilities:

  • Honest Listings: All product descriptions, images, and representations must be accurate and not misleading. Sellers may not misrepresent the condition, origin, or nature of the items.
  • Product Condition: Items sold must meet the described quality and functionality. Sellers must not sell defective or malfunctioning items unless clearly stated and agreed upon by the buyer.
  • Prompt Shipping: You must ship sold items within three (3) business days of receiving payment unless otherwise agreed upon by the buyer. Shipping must include a reliable courier with tracking information.
  • Tracking Information: Sellers are required to provide tracking numbers to buyers within two (2) business days after shipping. Failing to provide tracking could result in the withholding of payment or account suspension.
  • Buyer’s Protection: Sellers must honor all buyer protection policies outlined by K7Tracks, including facilitating returns or refunds when an item is not as described or is damaged during shipping.
  • Timely Communication: You must respond promptly to buyer inquiries and complaints in a professional manner, and failure to do so may result in penalties or account restrictions.
  • Payment of Fees: Sellers agree to pay any listing fees, transaction fees, and other associated costs as outlined in K7Tracks’ fee schedule. All fees are non-refundable, even in the case of disputes or product returns.

6. Payment and Fees

  • Fees: K7Tracks charges a non-refundable listing fee and transaction fee on every sale. Sellers are responsible for reviewing the fee schedule prior to listing an item.
  • Payouts: Sellers will receive payments after confirming shipment and providing tracking details. Payouts are subject to processing times and may take 3-5 business days.
  • Taxes: Sellers are responsible for calculating, collecting, and remitting any applicable taxes. K7Tracks does not provide tax advice and assumes no responsibility for tax compliance.

7. Returns, Refunds, and Cancellations

  • Return Policy: Each seller must clearly specify their return and refund policies. Failure to provide a policy will default the store to K7Tracks’ standard return policy, which allows returns for items not as described.
  • Defective Items: If a buyer receives a defective or significantly different item than described, the seller is responsible for accepting the return and issuing a refund.
  • Refund Process: If a refund is required, the seller must complete the refund process within five (5) business days of receiving the returned item.
  • Cancellation of Orders: Buyers may cancel orders prior to shipment. Sellers must honor cancellation requests if the item has not yet been shipped.

8. Seller Protection

  • Dispute Resolution: Sellers are protected under K7Tracks’ dispute resolution process, provided they follow all seller guidelines, including the provision of valid tracking information.
  • Chargebacks: In the event of a chargeback initiated by the buyer, K7Tracks will request documentation from the seller. Sellers must comply with such requests to defend against chargebacks.

9. Intellectual Property Rights

Sellers are responsible for ensuring that the products they list on K7Tracks do not infringe on any third-party intellectual property rights, including trademarks, copyrights, patents, or trade secrets. Selling counterfeit or unauthorized products is strictly prohibited.

  • Intellectual Property Complaints: K7Tracks will remove listings if intellectual property complaints are raised by rights holders.
  • Copyrighted Material: Unauthorized distribution or sale of copyrighted materials (such as software, music, and films) is prohibited unless the seller has explicit authorization to do so.

10. Limitation of Liability

K7Tracks acts as a platform for connecting buyers and sellers and does not participate in the sale of goods. K7Tracks is not responsible for:

  • Shipping delays, loss, or damages caused by third-party carriers.
  • Misrepresentation of product listings or disputes between buyers and sellers.
  • Losses, damages, or injuries related to items sold on K7Tracks.

By using K7Tracks, sellers acknowledge that the platform is not liable for any claims or damages arising from transactions between buyers and sellers, including issues related to fraud, shipping, product quality, or disputes.

11. Indemnification

Sellers agree to indemnify, defend, and hold K7Tracks, its affiliates, employees, and officers harmless from any claims, damages, or lawsuits arising from the seller’s use of the platform. This includes violations of laws, intellectual property disputes, and any legal claims related to the products sold by the seller.

12. Termination and Suspension

  • Voluntary Termination: Sellers may close their store at any time but are required to fulfill all outstanding orders and obligations.
  • Suspension: K7Tracks reserves the right to suspend or terminate a seller’s account for any violation of these Terms & Conditions. Repeated violations, fraudulent behavior, or failure to meet obligations will result in permanent account termination.

13. Modification of Terms

K7Tracks reserves the right to modify these Seller Terms & Conditions at any time. Sellers will be notified of changes via email or platform notifications. Continued use of the platform following any changes constitutes acceptance of the revised terms.

14. Governing Law

These Terms & Conditions are governed by the laws of the State of California and the County of Orange. Any disputes arising from the use of K7Tracks will be resolved exclusively in the courts located in Orange County, California.

15. Miscellaneous

  • Entire Agreement: These Terms & Conditions constitute the entire agreement between K7Tracks and the seller, and supersede any prior agreements or communications.
  • Severability: If any provision of these terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
