4. Transactions and Payments

  • Transaction Process: All transactions on the Marketplace are conducted between the buyer and the seller. K7Tracks facilitates the transaction by providing the platform, but we are not a party to the sale.

  • Payment Processing: Payments are processed through third-party payment processors, such as PayPal. By using the Marketplace, you agree to abide by the terms and conditions of these payment processors.

  • Platform Fees: K7Tracks charges a 5% platform fee on each transaction, which is deducted from the seller’s payment. This fee helps support the maintenance and operation of the Marketplace.

  • Release of Funds: Funds are held by K7Tracks until the buyer confirms receipt and satisfaction with the item. Once confirmed, the funds are released to the seller, minus any applicable fees.

5. Shipping and Delivery

  • Seller Responsibilities: Sellers are responsible for shipping items to buyers in a timely manner and for providing valid tracking information. Sellers must use reliable shipping methods to ensure that items arrive safely and in the condition described.

  • Buyer Responsibilities: Buyers are responsible for providing accurate shipping information and for receiving the items at the provided address. Any issues related to shipping or delivery must be communicated to the seller promptly.

  • Shipping Disputes: In the event of a dispute related to shipping, K7Tracks may intervene as a mediator. However, the ultimate responsibility for resolving the dispute lies with the buyer and seller.

6. Returns and Refunds

  • Seller Return Policies: Each seller may establish their own return and refund policies, which should be clearly stated in their store’s policy section. Buyers are encouraged to review these policies before making a purchase.

  • Refund Process: Refunds are generally issued when an item is returned in accordance with the seller’s return policy or when a dispute is resolved in the buyer’s favor. K7Tracks may issue partial refunds in certain cases, such as when restocking fees apply.

  • Dispute Resolution: If a buyer and seller cannot reach an agreement on a return or refund, the buyer may escalate the issue to K7Tracks for mediation. K7Tracks will review the case and work with both parties to reach a fair resolution.

7. Dispute Resolution and Mediation

  • Mediation Role: K7Tracks acts as a neutral mediator in disputes between buyers and sellers. While we aim to facilitate a fair resolution, we do not guarantee a specific outcome.

  • Binding Decisions: By using the Marketplace, you agree that K7Tracks’ decision in any dispute is final and binding. K7Tracks reserves the right to withhold funds, issue refunds, or take other actions deemed necessary to resolve a dispute.

8. Intellectual Property Rights

  • Respect for IP: You agree not to infringe on the intellectual property rights of others, including copyrights, trademarks, patents, and trade secrets. Sellers must ensure that all items listed on the Marketplace are their own original work or that they have the right to sell the items.

  • DMCA Compliance: K7Tracks complies with the Digital Millennium Copyright Act (DMCA) and will respond to notices of alleged copyright infringement. If you believe your intellectual property rights have been infringed upon, please submit a DMCA notice to K7Tracks.

9. Prohibited Items and Activities

  • Prohibited Items: Sellers are prohibited from listing items that are illegal, hazardous, or restricted by law. This includes, but is not limited to, counterfeit goods, stolen items, weapons, narcotics, and items that infringe on intellectual property rights.

  • Consequences: Listing prohibited items may result in the immediate suspension or termination of the seller’s account, and K7Tracks reserves the right to report such listings to the appropriate authorities.

10. Termination of Accounts

  • Account Termination: K7Tracks reserves the right to terminate any user’s account at any time, with or without notice, for violations of these Terms or any other reason deemed appropriate by K7Tracks.

  • Effect of Termination: Upon termination of an account, all pending transactions may be canceled, and any funds held by K7Tracks may be forfeited. Users may also be prohibited from creating new accounts in the future.

11. Privacy and Data Protection

  • User Data: K7Tracks is committed to protecting your privacy and personal data. Our Privacy Policy outlines how we collect, use, and protect your information when you use the Marketplace.

20. Entire Agreement
